If one party is mentally unfit at the time of marriage the marriage can be declared invalid or voidable because proper consent is missing. The law requires both individuals to be of sound mind so they can understand the nature of marriage. In simple terms, if a person is not mentally capable of giving consent the marriage may not be legally valid.
