Terms & Conditions

These terms and conditions (“Terms”, “Agreement”) are an agreement between Klass (“Klass”, “us”, “we” or “our”) and you (“User”, “you” or “your”). This Agreement sets forth the general terms and conditions of your use of the Klass website, web app, desktop app, mobile apps, browser extensions, and any of its products or services (collectively, “App” or “Services”).

When you sign up for an account and agree to these Terms, the Agreement between you and Klass is formed, and the term of the Agreement (the “Term”) will begin. The Term will continue for as long as you have a Klass account or until you or we terminate the Agreement in accordance with these Terms, whichever happens first. If you sign up for an account on behalf of a institute or other entity, you represent and warrant that you have the authority to accept these Terms and enter into the Agreement on its behalf.

Accounts and membership

If you create an account in the App, you are responsible for maintaining the security of your account and you are fully responsible for all activities that occur under the account and any other actions taken in connection with it. We may, but have no obligation to, monitor and review new accounts before you may sign in and use our Services. Providing false contact information of any kind may result in the termination of your account. You must immediately notify us of any unauthorized uses of your account or any other breaches of security.

We will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions. We may suspend, disable, or delete your account (or any part thereof) if we determine that you have violated any provision of this Agreement or that your conduct or content would tend to damage our reputation and goodwill, or you were rude or abusive to any of our team members. If we delete your account for the foregoing reasons, you may not re-register for our Services.

We may block your email address and Internet protocol address to prevent further registration.

Terminating and Reactivating Accounts

You or Klass may terminate the Agreement at any time and for any reason by terminating your Klass account or giving notice to the other party. We may suspend the Service to you at any time, with or without cause.

If your account is inactive for 1 month (roughly 30 days) or more, we archive your account. To reactivate an archived or restricted account, you must contact us and all pending invoices and outstanding balances must be paid in full before access is restored.

If your account is inactive for 12 months (roughly 365 days) or more, we may terminate your account. Once your account is terminated, you acknowledge and agree that we may permanently delete your account and all the data associated with it, including your course materials. We delete inactive data to ensure compliance with data protection regulations and to protect our systems.

Refunds

All payments made to Klass are non-refundable. You will not be entitled to a refund or credit from us under any circumstances, except as expressly stated below:

User content

We do not own any data, information or material (“Content”) that you submit in the App in the course of using the Service. You shall have sole responsibility for the accuracy, quality, integrity, legality, reliability, appropriateness, and intellectual property ownership or right to use of all submitted Content. But you grant us permission to access, copy, distribute, store, transmit, reformat, display and perform the Content of your user account solely as required for the purpose of providing the Services to you.

Billing and payments

You shall pay all fees or charges to your account in accordance with the fees, charges, and billing terms in effect at the time a fee or charge is due and payable. If auto-renewal is enabled for the Services you have subscribed for, you will be charged automatically in accordance with the term you selected. We reserve the right to change products and product pricing at any time. Any changes to pricing plans will be posted to our website or notified via email.

Uptime guarantee

We offer a Service uptime guarantee of 99% of available time per month. This does not apply to interruptions caused by periodic scheduled maintenance, your own activities, or causes beyond our control.

Limitation of liability

To the fullest extent permitted by applicable law, in no event will Klass be liable for any indirect, incidental, special, or consequential damages. The aggregate liability of Klass relating to the services will be limited to an amount greater of one pound or any amounts actually paid in cash by you to Klass for the prior one month period prior to the event giving rise to such liability.

Beta services

Beta services may be provided for evaluation or testing purposes and may contain bugs or errors. We may discontinue Beta services at any time in our sole discretion.

Acceptance of these terms

By using the App or its Services you agree to be bound by this Agreement. If you do not agree to abide by the terms of this Agreement, you are not authorized to use or access the App and its Services.
