Action Replay Not Layering in the Correct Order

I use Photostop CS4 and often use actions to do repetitive actions (ie: duplicate layer, sharpen, lower opacity, merge all together, for example) but recently I tried to save an action a little more extensive and the layers are in the wrong order. I had a color fill layer first and it ends up at the very top of the stack. Does anyone know how to fix that?
