Saturday is the 1st
just found out Saturday is the first, my resits are as early as next week, and limited revision time. just on a downer, fighting the effects of the battery 5 years ago, and all the depression seems hard. got some chill space now though.
8:50 pm
Feeling down, not done any study today, just flopped on the floor, with a cat on the bed, cleaning herself again.

update
Well its been over a year since redundancy, really struggling with course, the stress of living with one of my flatmates really hit hard. Its only now things are starting to sink in revision wise, and for all I know resits may have started, hope not.

Struggling to find new work, the esa is not enough to live off, especially as Im shouldering more than half the debts for the flats. Various religous have accepted me, despite my sexuality, and maveric religious ideals, crossing faiths.

just typing on a system that no-one uses
Next week its the start of the exams, though I am in no-way prepared. Also the illness is kicking in. The stress of the flat that has meant I have not done much never had space to, work is seemingly comming to an end. Been signed off sick from the Library but not seeing doctors now till wednesday. The councilling now has to move as that appointment was at the same time. It feels odd had an amazing NUS LGBT conference, had a full (nearly full delegation) again failed to get elected to steering. But was not a confused newbe like last year.

Fair Trade Stalls and International Womens day
Been busy running fair trade stalls in Newcastle.

Just got an unclear message from Northumbria Police Sergeant about having banners or placards highlighting global use of rape by police forces around the world. Concerns are that mentioning certain countries may be viewed by a Policeman (though will be lost in court by them) as incitement especially as Northumbria Police hands are not clean and they are one of the forces around the world that has done it in the past, so would be mentioned as a force that has used rape. This is for international womens' day, on the other hand if the idea is to build bridges then maybe trying to get justice for women is not in fitting with the aims of that campaign.

Positive Police
After all the lies, laughing at law, and plebgate by the Police, one Policeman shows it is possible to have a Brain, be in the Police and uphold the Law, even if he had no knowledge of Property Law, he did not make a quick snap decision, but understood, even the law of Tresspass and that a Bare Licence to walk onto the path was revoked. I think he may even had known what a "Bare Licence" was before arriving.

Ban proposals for Police liaision tents at Gay Prides
As a part of the campaign against Police gay DNA collection for things that should have been pulped decades ago like consensual sex between men. It seems I was not the first to propose banning Police liaison tents at Gay Pride Newcastle. Seems its already being considered as an option at several gay prides. Its also been pointed out that Police tents may be provocative in the atmosphere this is creating, even some gay police constables who we would like to work with as people who may be allies have said that actions such as that must be taken to force a backdown from those giving the orders, orders which they are shocked by.

There will certainly be protests outside such tents.

Operation Nutmeg
In discussions over "operation Nutmeg" this may be part of the problem as I argued elsewhere The records are very spurious, more likely to be court records than police records which the police will be unlikely to look at as these will be different to Police claims and will often take a lawyer to undersand what has been specifically proved or disproved, certainly wont be full transcripts read by the police, just court reporting. These are often on paper especially Police records archived in now deep storage. Many cottaging convictions and gross indecency were fabrications based solely on an undisputed word of Constable. People were convicted for holding hands or just because people knew they were gay. In America post MILK there was wholesale destruction of such records state by state as a total expungement so even names do not exist. In UK this did not happen. Ironically for many Pre Bichard report weeding means the Police don't know anymore even if in some court archive there is a record. This means the Police in some instances only have the title of the offence, not any of the circumstances and maybe unsafe convictions due to past Police and cultural homophobia. In America this wont be the case. Harvey Milk led to the destruction of many records of those convicted of homosexuality to avoid this. This was done at the same time of the destruction of records of those convicted by county ordinances or state legislation of those who interracial married. This is an argument especially in computer age of destroying all records in its entirety when things are decriminalized in effect ending the arrest and killing the conviction. As for the pre-equalisation convictions on age of consent especially for those who were 16 or 17 again for anyone to have taken it to court especially in pre-cps days shows homophobic mentality not to have just decided that the law was wrong.

It is amazing that this has happened in the same week that it was announced that San Francisco Airport in America was to become Harvey Milk International. Thus signifying increased acceptance of homosexuality in culture especially given Harvey Milk was in the same era as Stonewall when New York on the other coast provoked riots by storming gay bars, being led to be confronted by drag queen line dancing against Police batons. One must remember Harvey Milk formed an alliance with the teamsters by getting all gay bars to stop stocking Coors in their dispute, the first use of the Pink Dollar to combat and defend rights against threats to it alliances must be made.

Northumbria Police steps up to the bat and shows direct opposition to the Met on Gay issues
The key difference between Northumbria Police and the Metropolitan Police seems to be its minority treatment.

After deades of overt racism and homophobia the Met began including minorities even setting up Gay Police stations flying Gay flags in Soho with Gay Police and vetted Gay friendly straight Police (vetted by the Gay Police themselves). Much of this was after the arrest for Breach of the Peace of Peter Tachell for his arrest under international warrent of criminal politician Robert Mugabe in 1999.

Northumbria Police as has been said before to Politicans from many countries expressed support for Mugabes genocidal and homophobic regime including the comments made supporting the Tatchell arrest and Mugabe in 2009 in Newcastle over a discussion about Breach of the Peace meaning, and then have failed to give a statement before conferences which it was brought up at (an arrest which subsequent Met Commisioners have tried to distance the met from) , and the violent shutting down of the protest about Blair Peach in 2011 (and then Northumbria lost a court case about over the right to cite "Lord Justice Dyson"), whien the Met had made a public admission of guilt for, though is still letting the perpetrators go free, which is not right.

Now in a throw back to the 70's 80's and 90's of Police homophobia Northumbria Police and Manchster Police have began harrassing Gay people over long repealed laws which are unlawful under the European and International treaty in collecting dna of gay people as if Oscar Wilde was alive today he would be hunted by Police for his DNA for a repealled law. This includes veterans who were gay in the army after the decriminalistion for the public after 1967 and before the army offence decriminalisation of 1991. Lets not forget taking DNA samples is a form of Rape to victimise and use terror and power control over somoene, as well as theft of a commercially viable product (though not Rape in the legal lexiconology only the moral one).

Police demand DNA samples from gay men

Men convicted of victimless crimes threatened with arrest

Apparent government and ACPO sanction

Home Secretary & Chief Constables must halt & apologise

London - 14 January 2013

“Manchester and Northumbria police are visiting gay men convicted of consenting, victimless same-sex behaviour and demanding they provide DNA samples. In some cases, the men’s convictions date back three decades and were under homophobic laws that have since been repealed,” reports Peter Tatchell, Director of the human rights advocacy organisation, the Peter Tatchell Foundation.

“According to information I have received from the victims, police officers have turned up unannounced on their doorsteps and handed them letters requiring them to give DNA samples to be stored on a police data base alongside the DNA of murders, rapists and child sex abusers.

“The men have been warned that failure to comply will render them liable to arrest.

“The Home Secretary and Chief Constables must call an immediate halt to this homophobic witch-hunt and write personal apologies to all the men affected. They must give public assurances that the DNA samples will be destroyed.

“This anti-gay sweep is supposedly part of the government’s crackdown on serious violent and sexual offenders, using powers under the Crime and Security Act 2010. These powers were intended to ensure that everyone who is deemed to pose a threat to the public has their DNA matched against the DNA from unsolved crimes and has it stored on the national DNA data base to check against future crimes.

“Police have apparently lumped gross indecency - the victimless offence that was used to jail Oscar Wilde in 1895 - with violent sexual assaults and child molestation. The gross indecency law was only repealed in 2003.

“Given that this operation is sanctioned by the government and the Association of Chief Police Officers, similar witch-hunting and threats may well be happening in other police areas in other parts of Britain. They may not yet have been reported by victims and therefore not come to light.

“Men convicted of the now repealed consensual offence of ‘gross indecency’ are, in effect, being rebranded a serious criminals and treated on a par with the most vicious, violent sex fiends.

“They are being forced to go through the trauma of police abuse all over again.

“These letters and threats have left one man in Northumbria severely traumatised. He was arrested and convicted at the age of 17 for a consenting offence. Now, nearly 30 years later, he’s being forced to relive his past homophobic persecution by the police. He was the victim of bigoted policing in the 1980s. Once again he’s being maligned as a serious sex criminal,” said Mr Tatchell.

The Northumbrian man wants to remain anonymous because he fears repercussions. He told Mr Tatchell:

“I am now 45 years old with my own business. I have been in a relationship for over 10 years. Dragging all this up from my past has made me depressed. I now can't sleep or eat since it happened. I feel like stopping it. I am sick of it. I’ve been suicidal.”

He is not the only victim to come forward.

“Another man, Stephen Close, who now lives in Salford, was arrested and jailed for ‘gross indecency’ in 1983, when he was 20. He was in the army at the time and was abused by military police and subjected to violent assaults. He eventually confessed to having sex with a fellow squaddie,” added Mr Tatchell.

“Although homosexuality was partly decriminalised for civilians in 1967, it remain an imprisonable military offence until 1991. Mr Close was jailed for six months and discharged from the army with disgrace.

“Greater Manchester police claim his offence falls within the list of sex serious crimes that require DNA samples to be taken,” reports Mr Tatchell.

Mr Close said:

“How long must I endure this burden? Will I ever be able to lead a normal life without worrying whether my past will come back to haunt me?”

The letter to Mr Close from Greater Manchester Police states:

‘Through investigation of police records you have been identified as a person who has a previous conviction, which falls into one of the above categories (Gross Indecency 1983); and from whom we now wish to obtain a DNA sample....

‘The sample once taken will be processed and place on the National DNA Database, where it will be retained and may be subject to speculative searching either immediately or in the future.

‘You will be asked to consent to provide a sample. If you do not consent at this stage I require you to attend a police station within 7 days. The time and date of your attendance can be discussed with the person delivering this letter.

‘At the police station the sample may be taken with the authority of a police officer of the appropriate rank. If you fail to attend the police station as required you may be liable to arrest.’

Amnesty Student conference
The pictures of the Student conference are up on flickr, this is not a conference where I made a public speech in support of the defence of civil rights in England, but was one where I got to speak to Zimbabwean civil rights Leaders about the continuing and continuity of support of the English Police for the Mugabe regime from the 1999 Peter Tatchell arrest to the statement of support made in Newcastle outside the Laing art gallery for the Genocide of the Ndebele (Mtabele) in 2009 this ties in well as part of the regime is homophobic and the campaign against the Uganda kill the Gays bill is tied into it. Already I have reminded Northumbria Police that we are not protesting against English Policy as the UK Prime Minister is in faviour of the campaign as shown by the Ugandan Prime Minister ranting about a phone call he had from David Cameron in the Ugandan parliament making out that the west is obsessed with its policy to "protect the country from the wrath of god". I reminded Northumbria Police to keep back unless they want to be labeled as supporters not only of Homophobia in Zimbabwe but as supporting "gay genocide if such a word is not an oxymoron" in Uganda. That Northumbria Police never responded to questions about Zimbabwe shows they have still not changed its Laing gallery position.

Well Northumbria Police are clearly caught out lying.
Today I tested the Police Operations Handbook book. Despite having continually telling Police Breach of the Peace is not an offence, not in Criminal Law and not in common law they keep ignoring law school training..
So I have tried citing the page number 295 of the Police Operational Handbook. Its only when looking at in in Black and white do I get the Bazinaga moment.

Now if they at the start had said it was not an offence, then as its only offences that need to be reported to the US Embassy in London then that would have been problem solved, so one can only assume they did it deliberately to cause alarm and distress, the human rights act is now being looked into for them making the offence claim, and also I tihnk a pecunary damage case may be possible to be established for the use of that word, certainly non pecuniary damage.
There is also refusal to execute public office there, now that may be useful.

Tomorrow I will be very cranky, nearly finished the introduction to the battle of the forms, at this rate with no sleep I will be finished by 8am. I just realised I don't know the line spacing rules and not sure if Ibid. is allowed or meant to be used. However I have defined contract in 300 words, not including footnotes which I think may be counted but am not certain how they can be as the assignment is handed in manually. Next week when I go to London I need to decide if to take European Law, which I need to get a move on, criminal, or land law. I dont have much in the way of smaller guides for the Criminal or European though.

Despite being of a faith that considers caffine a drug and prohibits it, I can see myself drinking coffee tonight. Just realised one of my cats been asleep in my closed room all night where I have taken down my empty washing basket she has taken to liking sleeping on it. At least that means she is not making a crunching sound walking on all the case law on the floor or trying to sleep on me as I move towards the case law.

Plebgate Police caught liar liar pants on fire.
Well the Mitchell afair just goes to show that Police by being allowed to write reports and putting them on a computer (they used to take notes which were  rarely seen unless TESTED in court in a nook). has led to the Police using the computers to lie and big themselves up. 20 seconds became this whole Pleb thing, along with fake cooberation emails.

This attack on the Conservatives is like the Political attack on the then Liberals by Northumbria Police in 2009. That is still dragging on and new plans are afoot to get the report quashed as its a fabrication and is of no use except to continue the ongoing protests.

Been working on contract essay. Had largely stopped blogging as Live_journal is dead as a communications medium. Tweets the current thing, though the problem with twitter is that the amount of space to argue a point is so small its hard to do.

Last few weeks
Due to lack of money could not do much over Freshers week, fresher wise, though ended up doing a lot with the Christian Union. Also joined the Hindu Society and looking forward to some Prasadam on Wednesday.

Not heard anything from the Police about deleting the 1985 01/04/09 which is what the campaign for the past 3 and a half years has been about as it should never have been put on a computer in the first place. The head of the legal department seems slow at responding.

The Judicial review pre-application protocol is about to be written, as the deadline is approaching in order to then file a review on the Judge over the deletion of 1985 01/04/09

The Law course started, though I have been working the refurbishment job at the Uni library till now, so this week will be my first full week of study, will be about 2 weeks behind, so need to ensure I do a week and a half work for each week.

Gave a great speach about boycotting the Police, but Thames Valley Police have refused me permission to use there eye for an eye anti gang rap, despite the obvious Gandhi use who was a victim of the Police. Had a great idea to make it into a video, starting with archive footage of Police showing they don't want women to vote by attacking sufragettes, through to the attacks on Gandhi supporters by the Police, up to Thomlinson, Aspinal and now the execution of Dugan by the Police, With pictures of the damage the Police thugs have done to students, and democrats.

getting interest
Got some interest from MP's and PCC candidates on the campaign to delete 31/03/09 claims from computer which Northumrbria Police made over the telephone in September 2009 instead of putting them at the time. The name of the campaign is simplified as some Police do not get what they are being lobbied to do to delete incident log 1985 01/04/09 as it serves no Police purpose and is totally inacurate and misleading and was written without safeguards. The Schroedinger comments made at the time are spreading also. Heard back from someone else the story of it.

Requested use of rap music for anti violence video
Sent this to Thames Valley Police as there lyrics would go well in the anti-violence and anti Gang campaign
"I am wanting to use the rap video for a part of the "Peace on the streets" campaign, putting a new video on it. Given the use of the words of Gandhi a man beaten by Police, whose supporters were beaten by Police for Ahimsa (non violence) based protests and Satygrantha "Insistence of truth" gave me the idea as part of the anti gang campaign including the Largest gangs in the country of putting archive footage to it, in order to promote the Ahimsa based way of life including policing. My idea is to start with the Suffragettes and there treatment by the Police, to the Satygrantha salt protests where hundreds were beaten by the Police, through to the Special Patrol Group killing of Blair Peach in 1979 and finally onto the attacks by the Police on her majesties armed forces by the Police in the 21st Century such a war hero and Police victim Lance Corporal Mark Aspinal being an opponent of violence and supporter of the message of Gandhi and your gang being a proponent and user of violence and opponent of Gandhi I would like to check if this would breach any copyright on the music."

This is the video by the Thames Valley Police Gang http://www.thamesvalley.police.uk/newsevents-pressreleases-item.htm?id=226676
