OpenSSL does not currently appear to implement RFC6979 - Deterministic Usage of the Digital Signature Algorithm (DSA) and Elliptic Curve Digital Signature Algorithm (ECDSA). Determinstic ECDSA signatures are required by RFC6962-bis, the next Certificate Transparency standard.
