Why is this change necessary?
This PR addresses issues introduced in PR #8562, which added skip conditions for LMI tests. While that PR intended to skip all LMI tests, some tests were still running and causing failures due to incorrect skip logic. This change corrects the skip condition to ensure all LMI tests are properly skipped. Additionally, this PR removes the deprecated Python 3.9 version from the test configuration.
