Final Fury Privacy Policy – Game

We respect your privacy and are committed to protecting it through compliance with this Privacy Policy. Our Services are operated by Kluge Strategic, Inc. (d/b/a Kluge Interactive), (“we”, “us”, or “our”). Kluge Interactive is a US company and the data controller responsible for your personal data with its registered address at 4751 La Villa Marina, Unit K, Marina del Rey, CA 90292.

This Privacy Policy (“Policy”) explains how we collect, use, and protect your personal data when you interact with our websites, applications, and games (“Services”). It also outlines your rights and how you can manage your data, including deletion, updates, transfers, and access.

This Policy applies to information we collect on our Services, including finalfuryvr.com, and in electronic communications between you and our team. If you do not agree with our practices, please refrain from using our Services. Continued use of our Services after changes to this Policy constitutes acceptance of those changes. Before using our Services,  we are required to inform you about  the following policies, which govern your rights and responsibilities:

I. OUR ROLES

We operate as both a Data Processor and a Data Controller, handling your personal data, device data, and other related information (collectively, “personal data”) based on your interaction with our Services.

A. DATA PROCESSOR

As a Data Processor, we process personal data on behalf of third-party platforms (e.g., Community Platforms, Distribution Platforms) according to their instructions. In this role, we support our game titles and partnerships by processing data as directed by these third-parties, without deciding on the purposes or methods of data use.

B. DATA CONTROLLER

When acting as a Data Controller, we determine the purposes and means of processing personal data. This role applies to direct interactions with our Services, where we make decisions regarding data collection, usage, security, and storage, in compliance with applicable privacy laws.

Understanding these roles is crucial for exercising your privacy rights. When we act as a Data Processor, any inquiries or requests related to data processed on behalf of third-parties should be directed to the respective Data Controllers. When we act as a Data Controller, you can exercise your privacy rights directly with us, including requests for access, correction, or deletion of your personal data.

II. DATA COLLECTION

We may collect personal data through the Services about your use and how you use them. 

A. AGE REQUIREMENTS

Our Services are intended for users who have reached the age of majority, which is typically 13 to 18 years old, unless otherwise defined by local law. We do not knowingly collect personal data from individuals under this age. If you are under the age of majority in your jurisdiction, you may not use our Services without the explicit consent of a parent or guardian.

Parents or guardians are responsible for ensuring that their child uses our Services in compliance with this Policy. We require active parental consent before allowing minors to access our services, and parents are expected to supervise their child’s use of our services.

If we discover that we have collected data from an individual under the age of majority without proper consent, we will immediately initiate a documented deletion process to remove this data from our records within thirty (30) days. If you believe we have collected information from someone under the age of majority, please contact us at privacy@klugeinteractive.com, and we will take immediate steps to ensure compliance with applicable laws.

This policy is designed to comply with international data protection regulations, including but not limited to the Children’s Online Privacy Protection Act (“COPPA”), the General Data Protection Regulation (“GDPR”), and the California Consumer Privacy Act (“CCPA”). We may adjust our practices to align with local legal requirements in different jurisdictions to ensure full compliance.

B. DATA CATEGORIES

The type of personal data we collect depends on how you use our game. Over the past 12 months, and potentially in the future, we have collected or may collect the following categories of data in connection with the Services we provide:

  • Identifiers / Contact Data. Player’s unique platform identifier (Player ID), public display name (Player Display Name), IP address (Network ID).
  • Platform Data. Player’s headset type and platform used (e.g., VR platform or console).
  • Transaction Data. Data related to purchases (purchase history, delivery, date of purchase, item purchased, and unique platform/device ID). We do not collect sensitive payment information, such as credit card details or billing addresses.
  • Gameplay Data. Data related to your interactions with our game, such as gameplay data, leaderboard interactions, multiplayer service authentication, and social moderation (e.g., anti-cheat, player bans).
  • Device and Usage Data. Details about the device you use, including device type, operating system, software and hardware details, language settings, and how you interact with the game.
  • Audio / Visual Data. Images, avatars, and audio data captured through in-game chat features. Gameplay recordings may also include voice recordings, visual characteristics, and player movements, particularly in multiplayer testing or when using Mixed Reality features.

Note: We do not collect or display real names, physical addresses, or other direct contact information.

III. DATA SOURCES

The way we collect personal data depends on how you interact with our game services. For example, we collect personal data:

  • When you provide data directly to us by interacting with our Services, subscribing to newsletters or marketing, or reaching out for support.
  • From third-parties, such as advertising networks, business partners, third-party data providers, and other players; or from third-party platforms that manage access to our game.
  • Automatically, including through cookies, tracking technologies, and device data as you play our game or navigate related websites.

A. FROM YOU

You provide us with personal data when you engage with our game services, such as when you:

  • Use our Services or play our games;
  • Subscribe to in-game updates, newsletters, or marketing communications;
  • Participate in in-game chat, forums, or social features;
  • Purchase or redeem in-game items, content, or currency;
  • Download, install, or access game demos or full versions;
  • Contact us for game-related support or feedback;
  • Use in-game sharing or email features;
  • Participate in in-game events, tournaments, contests, promotions, or playtesting;
  • Provide data during any other in-game activity.

Depending on your activity, we may collect personal data such as your username, email address, payment information, platform ID, in-game performance data, survey responses, and geolocation. We may also collect data related to the systems or platforms you play on. This data may be combined across devices that you use for a seamless gaming experience.

B. FROM THIRD-PARTIES

We collect data when you access our Services through third-party platforms, such as gaming networks or social media accounts. These platforms may provide us with information about you, including your username, friends list, or other account data necessary to deliver our Services. The data shared depends on your activity on the third-party platform, and you may have control over what is shared with us. We are not responsible for the terms, policies, or actions of these third-party platforms.

We also receive data from third-parties to supplement the information we collect about you. This includes data from public databases, platform manufacturers, analytics providers, game developers, and other business partners. The data may include demographic information, interests, and publicly available data, such as social media content, which we may use to protect our users, employees, and Services or to assist in investigations. Additionally, we may receive information from other users of our Services, such as when you are mentioned in comments or when someone sends us a direct message.

C. FROM AUTOMATIC TOOLS

To enhance your experience and maintain the functionality and security of our Services, we use a variety of automatic tools to collect data as you interact with our platforms. This data is gathered directly from your device or through tracking technologies and helps us personalize your content and improve our features.

From Your Device

When you use our Services, we automatically collect data about your experience, including device and usage data, gameplay data, log data, and location data.

  • Device and usage data. We may collect device and usage data, such as your IP address, device type, operating system, browser type, and usage data.
  • Gameplay data. This includes your platform ID or gaming service ID, game achievements, scores, IP address, MAC address, and other device identifiers. We may combine this data with other information we have about you. We also use anti-cheat technologies to detect and prevent cheating.
  • Log data. We collect details on how you use our Services, including device information and event data. This helps us diagnose issues and improve our Services.
  • Location data. With your permission, we may collect location data through your device settings to provide location-based services, such as relevant content or ads.

From Cookies and Similar Technologies

Our Services use cookies and similar technologies to collect data, enhance your experience, and improve our Services. We use cookies (small text files stored on your device) to recognize you and personalize your experience on our Services. You can manage or delete cookies through your browser settings, though refusing cookies may limit your access to certain features. We also allow third-parties, such as social media and analytics providers, to use cookies and other tracking technologies on our Services.

IV. DATA PROCESSING

We use the personal data we collect to provide, maintain, and improve our Services, develop new offerings, and protect our users and ourselves.

B. LEGAL BASIS

For users in jurisdictions requiring a legal basis for data processing:

  • We process data to fulfill contracts, provide requested services, and facilitate gameplay.
  • We process data to comply with legal obligations.
  • We pursue legitimate interests to enhance our offerings, understand user preferences, and perform marketing (where consent isn’t required).
  • We protect vital interests where necessary.
  • We obtain explicit consent for specific processing activities, such as marketing communications.

V. DATA SHARING

We share your personal data in specific situations to support our Services, comply with legal obligations, and improve user experience.

A. GENERALLY

We share your data for the following reasons:

  • With Consent. We share data with your consent, including with third-parties such as hardware providers and software integrations necessary to provide our Services.
  • For Service Provisioning. Trusted partners process data on our behalf to deliver and support our services.
  • Legal and Safety Reasons. We disclose data to comply with laws, protect our rights, and ensure safety.
  • Business Transfers. In events like mergers or sales, your data may be transferred as part of the assets.
  • Analytical and Advertising Needs. We share non-identifiable data for analytics and targeted advertising.
  • Public Forums and Community Engagement. Information you share in public forums or events may be publicly visible.
  • Collaborative Efforts. We share data with third-parties for joint services or promotions, with clear communication at the point of collection.

B. CATEGORIES OF THIRD-PARTIES

We share your data with:

  • Affiliates. Companies within the Kluge Interactive family.
  • Service Providers. External companies providing services like hosting, analytics, payments, and marketing.
  • Advertising and Analytics Partners. Third-party providers for targeted ads and service usage insights.
  • Legal and Regulatory Authorities. Entities we must share data with to comply with legal obligations or protect our rights.

We partner with entities that uphold strong privacy practices. However, our Privacy Policy does not extend to third-party services linked from our platform.

C. PUBLIC INTERACTIONS

When you participate in our Services, your username and profile details may be publicly visible. Information shared in public forums or networks may also be accessible to others. Be cautious when posting sensitive information in public areas.

D. THIRD-PARTY LINKS

Our Services may contain links to third-party websites and services. When you leave our Services or use third-party services, our Privacy Policy no longer applies. Your interactions with those websites or services are governed by their own privacy policies and practices.

We do not monitor, control, or endorse the privacy practices of third-parties linked to our Services. We recommend that you familiarize yourself with the privacy policies of any third-party websites or services you visit. This Privacy Policy only covers personal data collected by us through our Services.

VI. DATA STORAGE & RETENTION

We store your data in the United States and keep it as long as necessary to provide services, meet legal obligations, or protect our rights.

A. STORAGE

By using our Services, you agree that your data may be transferred to countries, including the U.S. and China, which may have different privacy laws than your home country.

  • General Data. Most personal data, including gameplay and leaderboard data, is stored on Kluge-managed AWS services located in the U.S.
  • Analytic Data. Deidentified analytic data, including gameplay statistics and crash analytics, is processed on Unity Analytics servers, which may be located in various countries, including the United States and other regions where Unity operates data centers.
  • China-Specific Data. Data for players in China via Pico is stored on AWS services within China, per local regulations.

For data transfers outside your region, including from the UK or EEA, we ensure appropriate safeguards are in place to protect your data, including Standard Contractual Clauses or adequacy decisions recognized by the UK GDPR and the European Commission.

B. RETENTION

We retain the data we collect in accordance with our Retention Policy, for as long as necessary to provide our Services, and we may retain that data beyond that period if necessary for legal, operational, or other legitimate reasons.

  • Account Data. Retained while active and for 5 years after account termination or a request for deletion. Deleted thereafter.
  • Transactional Data (e.g., financial records). Retained for 7 years. Archived or deleted thereafter.
  • Biometric Data. Stored only momentarily as required by applicable law for operational purposes (such as authentication) and deleted immediately after use. Retained up to 3 years if necessary for legal compliance.
  • Communications and Inquiries Data. Retained for 2 years after resolution. Deleted thereafter.
  • User Generated Content. Retained while active and for 2 years after inactivity. Deleted or anonymized thereafter.

We may retain some personal data for a reasonable time to resolve disputes; enforce our terms and policies; administer Services; comply with technical and legal requirements; and maintain security, integrity, and operation of Services.

VII. DATA SECURITY

We prioritize your data security and take reasonable steps to protect it from unauthorized access, misuse, or alteration.

  • Security Measures. We have policies and technical measures in place to safeguard your data against unauthorized access, improper use, unauthorized modification, and accidental loss.
  • Confidentiality. All employees and data processors handling your data are required to maintain its confidentiality.

While we strive to protect your data, no system is completely secure. We cannot guarantee total security and are not responsible for unauthorized access, theft, or destruction of your data. Keep your login credentials confidential. If you suspect unauthorized activity related to your platform account, please contact the platform provider directly. For issues specific to our Services or data managed by us, please contact us at privacy@klugeinteractive.com.

In case of a data breach affecting your personal data, we will notify you as required by law and take steps to mitigate the breach’s impact.

VIII. YOUR RIGHTS

A. OVERVIEW

Depending on your location, you may have certain rights over your personal data, including:

  • Right to Access. You can request a copy of your personal data we process. Additional copies may incur a fee.
  • Right to Correct. If your data is incorrect, you can request corrections. We’ll notify others if we’ve shared the incorrect data, where possible.
  • Right to Delete. You can ask us to delete your data if we no longer need it or if you withdraw consent. We’ll notify others about the deletion, if possible.
  • Right to Object. You can object to us processing your data, particularly if it’s for direct marketing or based on legitimate interests.
  • Right to Withdraw Consent. If we rely on your consent for processing, you can withdraw it anytime.
  • Right to Restrict Processing. You can request to limit our processing of your data, but we may still store it.
  • Right to Opt-Out of Automated Decisions. You can opt-out of decisions made automatically, including profiling, if they significantly affect you.
  • Right to Data Portability. You can request your data in a usable format and ask us to transfer it to another service.
  • Right to Lodge a Complaint. If you have concerns about our privacy practices, you can report them to the FTC at https://reportfraud.ftc.gov/#/.

B. EXERCISING YOUR RIGHTS

You can make a data rights request in relation to your personal data by contacting us at privacy@klugeinteractive.com. We will respond to data requests within a month. We may take steps to verify your identity before we can respond to your request. To opt out of online personalized advertising more broadly, please see the controls available in the next Section IX. We will not discriminate against you for exercising any of these rights.

You may authorize someone to make a privacy rights request on your behalf (an authorized agent). Authorized agents will need to demonstrate that you’ve authorized them to act on your behalf or must demonstrate they have power of attorney pursuant to applicable probate law. We retain the right to request confirmation directly from you confirming that the agent is authorized to make such a request, or to request additional information to confirm the agent’s identity.

To the extent these rights apply to you, they may be limited in some situations — for example, when we are under a legal requirement or have a compelling interest in processing your personal data, or when the personal data is protected by trade secret. If you have unresolved concerns, where applicable, you may also have the right to complain to a privacy authority. Privacy Settings

You can manage your privacy settings within our Services and customize your preferences to actively manage the level of access and visibility of your personal data. 

Communications

If you receive an unwanted email from us, you can use the unsubscribe link found at the bottom of the email to opt out of receiving future emails. Note that you will continue to receive transaction-related emails regarding products or Services you have requested. 

We may also send you non-promotional communications regarding us and our Services regarding our Services or updates to our Terms or this Privacy Policy. 

Advertising

If you prefer not to receive marketing messages or sponsored content, please contact us at privacy@klugeinteractive.com and we will ensure your preferences are updated accordingly.

Do Not Sell or Share My Personal Information (CCPA)

If you are a resident of California, you have the right under the California Consumer Privacy Act (CCPA) to opt out of the sale or sharing of your personal information. To exercise this right, please contact us at privacy@klugeinteractive.com with your request.

B. WITH THIRD-PARTIES

Our Services integrate with various third-party  providers, including Community Platforms, Distribution Platforms, Marketing Providers, Payment Processors, and Security and Performance Providers. You can customize your privacy settings within your account settings through these providers to control the data that is shared with us. We encourage you to review their corresponding Terms of Service and Privacy Policy through the links below.

Accounts

While we do not manage platform accounts directly, third-party Distribution Platforms provide the login credentials and account management for accessing our game. For issues regarding your platform account security, such as compromised login credentials, please reach out to the platform provider. Kluge Interactive manages data specific to gameplay and Services but is not responsible for external platform account management.

X. GENERAL PROVISIONS

A. POLICY UPDATES

We may make changes to this Privacy Policy from time to time.

To ensure that you are always aware of how we use your personal data, we will update this Privacy Policy to reflect any changes to our use of your personal data. We may also make changes as required to comply with changes in applicable law or regulatory requirements.

We will make available to you here any significant changes to the policy, whether based on a change of law or otherwise. However, we encourage you to review this Privacy Policy periodically to be informed of how we use your personal data.
