Terms and Conditions

This In-Home Service Agreement is entered into between you, hereafter known as the “Client,” and Fertility Home Care LLC, hereafter known as the “Service Provider”. The medical professional performing services in partnership with Fertility Home Care LLC will be known as the “Professional”. 

The purpose of this Agreement is to clearly outline the professional relationship, responsibilities, limitations, expectations, and legal protections surrounding in-home medication services. By scheduling or receiving services from the Service Provider, the Client agrees to the terms and conditions described below.

 

  1. PRIVACY

1.1 Confidential Information
The Service Provider acknowledges that, in the course of providing services, it will have access to confidential information about the Client, the Client’s family, partners, or friends. This includes—but is not limited to—medical history, prescribed medications, treatment protocols, personal identifying details, address, financial information, health insurance coverage, and scheduling information.

1.2 Confidentiality Obligations
All information obtained is confidential and may not be disclosed except:

  • As required for safe and accurate medication and injection support

  • As needed to confirm medication instructions or other health related information with the prescribing clinic

  • As permitted by the Privacy Policy

  • As required by law (e.g., in the case of abuse, danger to self or others, subpoena, etc.)

1.3 Protected Health Information (PHI)
For purposes of this Agreement, Protected Health Information (“PHI”) refers to any individually identifiable health information that relates to the Client’s medical condition, treatment, medications, medical history, or any information tied to the Client’s identity.

PHI will only be used for the purpose of providing, coordinating, or confirming the Client’s scheduled in-home services. 

1.4 Survival of Obligation
These confidentiality obligations survive termination of this Contract indefinitely.

 

  1. LICENSING & QUALIFICATIONS

2.1 Licensed Personnel
The Service Provider warrants that each Professional providing services holds an active license in the state where services occur. The most common licenses include, but are not limited to:

  • Registered Pharmacist (RPh), Registered Nurse (RN), Licensed Practical Nurse (LPN), or Nurse Practitioner (NP)

2.2 Professional Standards
Each representative maintains their current licensure and all certifications and/or training required to maintain that licensure. Each representative will be actively licensed to provide injection support during the date of service agreed upon for the Client.

2.3 Verification
Licenses are verifiable upon request.

 

  1. DESCRIPTION OF SERVICES

The Service Provider offers two main types of services: Injection Training & Injection Administration sessions.

3.1 Training Sessions (1 hour or less)
Training sessions include:

    • Reviewing clinic instructions and ensuring the Client has all necessary medication(s) and supplies to start therapy

    • Demonstrating sterile medication preparation (i.e. vial mixing, pen priming, reconstitution, etc.)

    • Reviewing the selection and preparation of proper injection site(s)

    • Assisting the Client or Client’s partner/support person to practice preparation and injection technique

    • Providing safety guidance (i.e. needle handling, sharps disposal, etc.)

    • Answering medication or injection related questions

  • Reviewing timing and scheduling considerations

3.2 Administration Sessions (30 minutes or less)
Administration sessions include:

    • Reviewing clinic instructions and ensuring the Client has all necessary medication(s) and supplies to start therapy

    • Preparing medication(s) using sterile technique

    • Identifying and preparing the injection site(s)

    • Administering the subcutaneous or intramuscular injection(s) and properly disposing of any sharps products

    • Monitoring the Client briefly for immediate reactions

  • Providing guidance for aftercare if necessary

3.3 Client-Supplied Items Required for All Sessions
The Client must provide:

  • All prescribed medications to be administered

  • Clinic instructions with intended dose, timing, route of administration and any other pertinent medication storage, preparation, mixing or administration instructions

  • All administration supplies including, but not limited to, needles, syringes, diluent vials, alcohol wipes, sterile supplies and a puncture proof disposal container

  • Any additional tools, devices or items required by their specific medication protocol
    If any of these items are missing, damaged, empty, unusable or expired, the Service Provider or Professional may decline service for safety reasons.

3.4 No Prescription Authority
The Service Provider or Professional does not prescribe, adjust, alter, or recommend medication changes.

3.5 No Clinical Decision-Making
The Service Provider does not interpret lab results, determine treatment plans, or provide fertility counseling or medical advice. The Client must inform the Service Provider and Professional of all medication changes, such as dose changes, additions or subtractions from their regimen. The Service Provider and Professional are not liable for any incorrect or missed doses if not provided with the details from the Client or their fertility clinic at least 4 hours prior to the start of their in-home visit.

3.6 Non-Emergency Nature
The Service Provider does not replace emergency medical care. If an emergency arises, the Client must call 911 immediately.

 

  1. CLIENT RESPONSIBILITIES

4.1 Accurate Information
The Client must provide complete and truthful information, including:

  • Any allergies (especially latex or medication-related)

  • Recent reactions or complications

  • Pregnancy status, if relevant

  • All items listed in section 3.3 above

 

The Service Provider is not responsible for errors arising from inaccurate or incomplete information provided by the Client or their clinic.

4.2 Safe Environment
The Client agrees to provide:

    • A clean, sanitary workspace

    • Adequate lighting

    • A stable, flat surface for medication preparation

    • A quiet, safe area free of distractions

    • Secured pets (i.e. in another room)

4.3 Presence and Readiness
The Client must be present, prepared, awake, and sober for the duration of the arrival window for the appointment visit. Being under the influence of alcohol or substances may result in termination of the visit.

4.4 Non-Interference Clause
The Client acknowledges that unnecessary involvement by others can increase risk of clinical error. Interference by family, friends, or observers may result in immediate termination of the session.

4.5 Supplies on Hand
The Client must ensure that all medication supplies are organized, present, and accessible at the time of service to avoid delays or errors.

 

  1. AVAILABILITY, ARRIVAL, AND RESCHEDULING

5.1 Availability
All visits are subject to Professional availability. Availability for requested dates of service will be assessed after a deposit is obtained from the Client. If services cannot be secured on an agreed upon date of service between the Service Provider and Client, the deposit will be fully refunded. If services can be secured on an agreed upon date of service between the Service Provider and Client, the deposit will be credited and applied to the invoice for service.

5.2 Confirming Scheduling
For every in-home service visit that is confirmed, the details will be shared amongst the Client, the Service Provider and the Professional performing the service. It will contain the Client’s information, including their name, address and phone number, the Professionals name, a 30-minute arrival window, the medication(s), dose(s), route of administration and additional instructions.

5.3 Arrival Window
The Professional will be given a 30-minute arrival window for each confirmed in-home service to account for weather, traffic, and other possible issues that may arise and cause delays. The Professional can arrive any time within the arrival window to perform services. 

5.4 Late Client Policy
If the Client is not home or ready during the 30-minute arrival window, the visit may be shortened, rescheduled, or cancelled and treated as a billable session.

5.5 Delays Beyond Provider’s Control
Traffic, weather, accidents, or unexpected medical emergencies can occur and/or may cause delays. If the Professional is unable to perform the requested service, arrive within the arrival window, or the window time must be changed, the Service Provider or Professional will notify the Client as soon as reasonably possible and make all possible efforts to ensure the visit continues. 

In the event services cannot be provided in the same 24-hour period, a refund for that visit will be issued. 

5.6 Time-Sensitive Injections
The Client is responsible for providing accurate information regarding the required time of administration for time-sensitive medication (i.e. trigger shots, progesterone in oil, etc.). The Service Provider will schedule the Professional arrival time at least 10 (ten) minutes prior to the scheduled injection time to allow for medication preparation, injection site preparation and other steps necessary to ensure timely administration.

If a time-sensitive medication cannot be administered at the scheduled time, a refund may be issued.

 

  1. PAYMENT TERMS

6.1 Payment Prior to Service
A detailed invoice will be sent prior to services being rendered and payment must be made in full prior to the start of services. If payment is not received, services may be delayed or cancelled. All payment options will be listed on the invoice.

Accepted payment methods include credit card, Zelle or Venmo.

6.2 Insurance and pre-taxed accounts
Insurance will not be billed prior to services. The Client acknowledges and agrees that all services provided by the Service Provider are offered on a self-pay basis. The Service Provider does not bill, submit claims to, or communicate with any private health insurance plans, employer-sponsored plans, Medicare, Medicaid, or any other third-party payer for reimbursement of fees associated with the services provided.

6.3 Reimbursement Responsibility
If the Client seeks insurance reimbursement, they must submit claims themselves. The Client can request specific information on the invoice to submit for insurance reimbursement. The Service Provider will provide all reasonable information including service codes, identification numbers, tax codes, and other information on the invoice for the Client.

The Service Provider makes no warranties or guarantees that the Client’s insurance company will reimburse the Client for fees paid, whether in part or in full. If the Client chooses to independently submit receipts or invoices to their insurance carrier, they do so entirely at their own discretion and risk. The Service Provider will not communicate with the insurance company on the Client’s behalf, respond to insurance inquiries, or complete any additional documentation beyond what is provided directly to the Client.

6.4 Outstanding Balances
Unpaid balances may result in cancellation of future services.

 

  1. CANCELLATION POLICY (link)

7.1 Notice Requirement
Cancellations require at least 24 hours notice. 

7.2 Late Cancellation Fee
Less than 24-hour notice results in a fee equal to 50% of the service price being charged to the Client.

7.3 Exception
Cancellation fees are waived only when cancellations are caused by:

  • A pregnancy test result

  • Physician-directed cycle changes or cancellations

  1. LIMITATION OF LIABILITY

8.1 No Guarantee of Outcome
The Service Provider cannot guarantee:

    • Treatment success or specific outcomes

    • Medication effectiveness

  • Prevention of complications

8.2 Inherent Risks of Injection
Client acknowledges risk of:

    • Bruising or bleeding

    • Medication related side effects

    • Pain or swelling

    • Injection site reactions

    • Allergic or sensitivity reactions

    • Infection

  • Improper response to medication

8.3 Client-Supplied Medication Liability
The Service Provider is not liable for issues arising from:

    • Expired, damaged, or improperly stored medications

    • Incorrect instructions from the Client or their fertility clinic

    • Defective supplies

  • Missing or incomplete materials

8.4 Cap on Liability
Liability for any claim is limited to the cost of the specific appointment during which the alleged issue occurred.

 

  1. RIGHT TO REFUSE OR TERMINATE SERVICES

The Service Provider may refuse or end a session immediately if:

  • The environment is unsafe

  • The Client is not present or impaired

  • Supplies are missing, contaminated, or unusable

  • Interference occurs

  • The Client requests actions outside scope of practice

  • The Client is aggressive, threatening, or inappropriate (See our Community Guidelines)

Termination for these reasons may still result in a full-charge session.

 

  1. INDEMNIFICATION

The Client agrees to indemnify and hold harmless the Service Provider, its owners, officers, agents, Professionals, and representatives from claims, damages, losses, or liabilities arising from:

  • Incorrect or incomplete information provided by the Client

  • Use of improper, expired, or defective medications

  • Preexisting medical conditions

  • Actions taken against professional recommendations

  • Environmental hazards in the Client’s home

This clause survives termination of this Contract.

 

  1. ATTORNEYS’ FEES

If a breach of this Contract occurs, the breaching party agrees to pay reasonable attorney fees and costs incurred by the other party in enforcing this Contract. The prevailing party in any dispute arising from this Contract is entitled to recover reasonable legal fees and associated costs.

 

  1. GOVERNING LAW

This Contract will be governed and interpreted according to the laws of the state in which services are rendered, without regard to conflict-of-law doctrines.
