As part of your Occupational Health and Safety (OHS) management system, the goal is to support recovery while maintaining the employee\u2019s connection to the workplace. <\/p>\n\n\n\n<p>A Return to Work program benefits the employee and the employer, and may include temporary, modified, or alternate duties, adjusted hours, or workplace accommodations based on medical guidance.<\/p>\n\n\n\n<p>There\u2019s a lot to consider when creating your organization\u2019s Return to Work program. class=\"wp-block-list\">\n<li>Employers and employees have a legislative responsibility to collaborate in the Return to Work process actively (<a href=\"https:\/\/www.worksafebc.com\/en\/law-policy\/workers-compensation-law\/amendments\/bill-41-amendments-to-the-workers-compensation-act\">Bill 41<\/a>).<\/li>\n\n\n\n<li>Employers must identify and offer modified duties that are safe, productive, and meaningful, taking into account the worker\u2019s functional abilities, where possible.<\/li>\n\n\n\n<li>Employers may choose to offer alternative duties when modified duties of the worker\u2019s primary duties are considered unsafe through a functional ability assessment.<\/li>\n\n\n\n<li>If a worker has been employed for at least 12 continuous months prior to injury, it is the employer\u2019s responsibility to re-employ them to their pre-injury position or a comparable position when medically able.<\/li>\n\n\n\n<li>Reasonable effort must be made to accommodate worker\u2019s limitations unless it causes undue hardship.<\/li>\n\n\n\n<li>WorkSafeBC may impose financial penalties on employers who fail to meet Return to Work
