GENERAL TERMS AND CONDITIONS OF USE - INDIVIDUALS
Preamble
These General Terms and Conditions of Use (hereinafter "GTCU Individuals") govern the use of the CARTOBIKE platform (hereinafter the "Platform") by individual users (hereinafter the "User" or "Users").
Article 1 - Purpose of the Platform
1.1. CARTOBIKE is a networking platform that allows individuals and professionals to offer, sell or purchase vehicles (cars, bicycles, scooters) and related services.
1.2. CARTOBIKE acts as a technical intermediary and does not own any of the vehicles offered for sale. Sales contracts are concluded directly between sellers and buyers.
1.3. CARTOBIKE is not a wholesale or retail company. We do not intervene in transactions between buyers and sellers and do not transfer ownership of vehicles.
Article 2 - Acceptance of the Terms and Conditions
2.1. Access to and use of the Platform implies full and complete acceptance of these Terms and Conditions.
2.2. If you do not accept these terms and conditions, please do not use the Platform.
2.3. CARTOBIKE reserves the right to modify these Terms of Use at any time. Modifications shall take effect as soon as they are posted online. It is your responsibility to regularly consult the latest version in force.
Article 3 - Registration and User Account
3.1. Registration conditions
Registration on the Platform is reserved for natural persons of legal age with full legal capacity.
3.2. Required information
When registering, the User provides:
- First name, surname
- Full address
- Valid email address
- Telephone number
- Secure password
3.3. Identity verification
To access certain features (including auctions and secure transactions) and to help maintain a secure environment, Users can confirm their identity by completing a two-step verification process:
Step 1: Anti-impersonation verification selfie
- Send a real-time selfie in which the User holds their identity document next to their face, in a visible and legible manner
Step 2: Identity document
- Send a copy of both sides of a valid official identity document (national identity card, passport or residence permit)
Why this verification?
This two-factor authentication procedure allows us to:
- Verify that you are the holder of the identity document presented
- Prevent identity theft and document fraud
- Protect all members of the Cartobike community from scams
- Guarantee the security of transactions between buyers and sellers
- Award you a "Verified User" badge visible on your profile, boosting your credibility
Verified User Badge
Once your identity has been confirmed, you will receive a "Verified User" badge (✓) displayed on your public profile. This badge:
- Reassures other users during your transactions
- Increases confidence and facilitates the sale of your vehicles
- Helps create a safe and trustworthy community
- Gives you access to advanced features (auctions, Hot Deals)
CARTOBIKE's limitation of liability
IMPORTANT: The "Verified User" badge only certifies that the User has provided an identity document and a selfie accepted by CARTOBIKE during verification. This badge does not constitute:
- An absolute guarantee against fraud, identity theft or false documents
- A certification of the User's solvency, honesty or commercial reliability
- A commitment of liability on the part of CARTOBIKE in the event of a dispute, fraud or criminal behaviour on the part of a verified User
CARTOBIKE takes reasonable steps to verify the authenticity of the documents provided, but cannot guarantee the total absence of sophisticated document fraud (false documents, deepfakes, etc.).
Vigilance recommended
Even with a verified User, you should ALWAYS:
- Verify the identity of the person you are dealing with before making any payment or transferring funds
- Physically inspect the vehicle before paying
- Use secure payment methods (tracked bank transfer, secure payment platform)
- Never send cash or use untraceable methods (Western Union, cryptocurrencies, etc.)
- Immediately report any suspicious behaviour using the "Report" button available on each profile

CARTOBIKE cannot be held liable for any loss, damage or harm suffered by a User during a transaction with another User (even if verified), as CARTOBIKE acts solely as a technical intermediary.
3.4. User Profile
Each User has a profile (private or public) which displays:
- Their vehicles for sale
- The reviews and comments received
- The vehicles they are following
Users can be followed by other members and can follow other profiles.
3.5. Number plate feature
Users can register a number plate attached to one of their vehicles to allow other Users to contact them in the following situations:
- Obstructive parking
- Accident or damaged vehicle
- Contact request
3.6. Account security
The User is solely responsible for the confidentiality of their login details. Any use of their account is presumed to have been made by them.
In the event of fraudulent use or theft of login details, the User must immediately inform CARTOBIKE at: contact@cartobike.com
Article 4 - Account deletion
4.1. Deletion procedure
Users may delete their accounts at any time from their personal space:
My account > Settings > Permanently delete my account
4.2. Exception for technical difficulties
In the event of proven technical difficulties preventing deletion via the interface, Users may, on an exceptional basis, contact customer service atcontact@cartobike.com .
Conditions for admissibility of the request:
In order for your deletion request by email to be processed, you must provide:
1. A screenshot clearly showing the technical problem encountered (error message, display bug, inability to access, etc.)
2. A detailed explanation of the problem:
- A precise description of the error
- Steps taken before encountering the problem
- Browser and device used (e.g. Chrome on PC, Safari on iPhone)
- Date and time of the attempt
Important: Requests for deletion by email without a screenshot or explanation of the technical problem will not be processed.
Reason: We have set up a simple deletion system that can be accessed directly from your personal space (My Account > Settings > Permanently delete my account). This email exception is reserved exclusively for cases of genuine technical impossibility, in accordance with the GDPR obligation to facilitate the exercise of your rights (Article 12.2 GDPR).
Processing time: Requests that meet the above conditions will be processed within a maximum of 7 working days.
4.3. Distinction from newsletter unsubscription
Unsubscribing from the newsletter (accessible from the emails received or the personal space) does not delete the User account.
4.4. Consequences of deletion
Restrictions prior to deletion
Deleting your account is not possible in the following situations:
a) Winning bid not finalised
If you have won one or more auctions and the transaction has not yet been finalised (payment and delivery not completed), you must:
- Option 1: Finalise the purchase of the vehicle(s) in accordance with the Marketplace Rules (payment within 5 working days + delivery)
OR
Option 2: Request cancellation of the transaction from the seller with their express agreement. Depending on the circumstances:
- No penalty: If the seller agrees to the amicable cancellation (written agreement required)
- With penalty: If the seller refuses the amicable cancellation, you will have to pay the fixed compensation provided for in the Marketplace Rules, and your deposit will be retained in accordance with the conditions accepted when you placed your bid
Important: Any attempt to delete your account in order to evade your contractual obligations will be considered a serious breach of these Terms and Conditions and may result in:
- Permanent blocking of account deletion until the situation is rectified
- Retention of your deposit
- Legal proceedings for breach of contract
- - Your inclusion on a list of fraudulent accounts, prohibiting any re-registration
b) Ongoing transaction (Hot Deals, booking)
If you have a Hot Deals reservation in progress (48-hour period not expired) or any other unfinished transaction, you must first:
- Finalise the transaction in progress
- Or wait for the reservation period to expire
c) Ongoing dispute
If you are involved in a dispute that is currently being resolved (dispute, mediation, appeal), the deletion of your account will be suspended until the dispute is finally resolved.
Consequences after fulfilment of obligations
Once your obligations have been fulfilled (transactions finalised, disputes resolved), the deletion of the account will result in:
- Immediate deactivation of the profile
- Deletion of active listings
- Permanent loss of unused credits and services
- Data retention for 14 days (technical backups) followed by permanent deletion, unless otherwise required by law (accounting, disputes: retention for 10 years)
Notification to the seller
In the event of a winning bid, the seller will be automatically notified if you attempt to delete your account before finalisation. This measure protects sellers from bidders acting in bad faith.
Article 5 - Rules of Use
5.1. The User undertakes to use the Platform in accordance with the laws in force and these Terms of Use.
5.2. It is strictly prohibited to:
- Publish content that is illegal, defamatory, discriminatory, hateful, violent, pornographic or contrary to public order
- Selling stolen, counterfeit or non-compliant vehicles
- Manipulating prices, auctions or evaluations
- Creating multiple accounts for the same user
- Impersonating a third party
- Collecting data from other Users for unauthorised commercial purposes
- Using robots, scripts or any automated process to access the Platform
- Spreading viruses, malware or any malicious code
- Circumventing the Platform's security measures
- Harassing, threatening or intimidating other Users
5.3. Penalties
In the event of a breach of these rules, CARTOBIKE reserves the right to:
- Delete the disputed content
- Temporarily or permanently suspend the account
- Ban the User from the Platform
- Take legal action
- Report the facts to the competent authorities
5.4. Prohibition of impersonation
Principle
It is strictly prohibited for any Professional to use a Private account for the purpose of:
- Benefit from conditions reserved for private users (free of charge, no professional obligations)
- Circumvent the obligations applicable to professional sellers
- Conceal their professional status from buyers
- Evade B2C rules (legal guarantees, right of withdrawal, etc.)
Examples of prohibited behaviour:
- Using a private account while engaged in the professional sale of vehicles
- Using a private account to regularly sell vehicles in a commercial context
- Concealing one's professional identity to avoid paying for a subscription
Detection and penalties
CARTOBIKE actively monitors suspicious behaviour and can detect fraudulent use of a private account by a professional, in particular by:
- The number and frequency of sales
- The professional nature of the advertisements (stock, professional photos, standardised descriptions)
- Reports from other users
- Cross-checking with official registers (company numbers, registrations)
If status fraud is detected, CARTOBIKE reserves the right to:
1. Immediately reclassify the account
- Forced conversion of the Private account to a Professional account
- Immediate application of the Professional Terms and Conditions of Use and Terms and Conditions of Sale
2. Retroactive billing
- Claim subscription fees for the entire period of fraudulent use (up to a maximum of 12 months retroactively)
- Calculation based on the current monthly rate multiplied by the number of months of use
- 20% surcharge for management fees and damages incurred
3. Additional penalties
- Immediate suspension of the account until full settlement
- Removal of all active advertisements
- Permanent loss of all credits and services
- Permanent ban in the event of a repeat offence
- Reporting to the competent authorities (fraud, unfair competition)
4. Responsibility towards buyers
- The Professional remains solely liable to buyers for any breach of professional obligations (legal guarantees, etc.)
- CARTOBIKE may take action against the Professional for any damage suffered
Example of retroactive billing:
A professional fraudulently uses a private account for 8 months:
- Monthly subscription: [Rate displayed at the time of subscription] £/month × 8 months
- 20% surcharge: + (total amount × 20%)
- = Total amount due before reactivation of the account
Appeal
If you believe that the reclassification of your account is unjustified, you have 15 days to submit your comments and supporting documents proving your status as a private individual (no professional activity, occasional sales, etc.).
Clarification: Occasional sales by private individuals
An individual may occasionally sell their own vehicles without being considered a professional, as long as:
- Sales remain occasional
- The vehicles are personal vehicles (no systematic purchase and resale)
- There is no commercial organisation (no stock, no commercial margin)
- There is no professional advertising
Article 6 - Automated Moderation
6.1. Purposes
CARTOBIKE uses automated tools (robots, artificial intelligence) to analyse and filter messages and content exchanged via the Platform for the following purposes:
- Detect and censor content that contravenes these Terms of Use
- To identify fraudulent behaviour (scams, spam, phishing)
- To protect Users from scams
- Continuously improve detection systems
6.2. Keywords and warning signals
Moderation systems identify keywords and recurring behaviours associated with fraud. Accounts involved may be automatically banned.
6.3. Appeals
Any User who believes they have been subject to unjustified moderation may contact customer service atcontact@cartobike.com to request a manual review.
Article 7 - Reporting and Blocking
7.1. Reporting ads
Each advertisement has a "Report" button that can be used to notify us of content that is abusive, fraudulent or contrary to the rules.
7.2. Reporting and blocking in messaging
Users may report or block other Users in the event of inappropriate behaviour or harassment.
7.3. Processing of reports
Each report is analysed by the moderation teams. In the event of a proven violation, CARTOBIKE will apply the penalties provided for in Article 5.3.
Article 8 - Sale (Private Sellers)
8.1. Free for private individuals
Private Users benefit from an unlimited number of free listings.
8.2. Publication period
Advertisements are displayed for 150 days. After this period, they are automatically deactivated. Users can extend an advertisement for an additional 30 days from their personal space.
8.3. Terms of sale
Selling Users may offer their vehicle:
- At a fixed price
- At auction (with or without a minimum price)
8.4. Accuracy of information
The seller guarantees:
- That they are the owner of the vehicle or have authorisation to sell it
- The truthfulness and accuracy of all information provided (description, mileage, condition, history)
- The vehicle's compliance with European standards and regulations in force
- The authenticity of the photos (actual photos of the vehicle, not catalogue photos)
CARTOBIKE automatically generates certain technical information from the data entered. This information is not guaranteed and must be verified and approved by the seller before publication.
8.5. Price displayed
The price indicated in the advertisement is inclusive of all taxes.
8.6. Photos
The use of licensed images or images belonging to third parties without authorisation is prohibited. CARTOBIKE may remove any photos that violate intellectual property rights.
8.7. Status of the advertisement
Article 8.7 - Advertisement Status and Transaction Process
8.7.1. End of the auction
At the close of the auction, the User who submitted the highest bid is notified by email and push notification (mobile application). The status of the advertisement in their personal space is updated.
8.7.2. Acceptance or refusal by the seller
The seller has a period of time (often 24 hours) to accept or reject the best bid from their personal space.
If accepted, the buyer is immediately notified by:
- Push notification on the mobile application
- Confirmation email
- Status update in their personal account
The status of the listing then changes to "Reserved".
8.7.3. Vehicle blocking
Once the seller has accepted the offer, the vehicle is blocked for a minimum period of 5 working days.
During this period, the buyer is invited to:
- Inspect the vehicle before making any payment
- Check the condition of the vehicle and its compliance with the advertisement
- Only proceed with payment after inspection
Important: No deposit is required during this reservation period. The vehicle will be reserved for a minimum of 5 working days without a deposit.
8.7.4. Payment
After inspection and approval of the vehicle by the buyer, the buyer shall make full payment for the vehicle within the specified time limit (5 working days).
Payment must be made in accordance with the terms agreed between the buyer and the seller.
8.7.5. "Delivery in progress" status and release of the deposit
After receiving full payment, the seller must click on the "Delivery in progress" button in their personal account.
This action automatically releases the buyer's deposit.
The status of the listing then changes to "Delivery in progress".
8.7.6. Confirmation of delivery by the buyer
Once the status has changed to "Delivery in progress", the buyer can confirm receipt of the vehicle from their personal account by clicking on "Confirm delivery".
The transaction is considered to be definitively finalised:
- Either immediately after manual confirmation by the buyer
- Or automatically after a period of 24 hours following the change to "Delivery in progress" status (tacit confirmation)
8.7.7. Recovery of the deposit
Once delivery has been confirmed (manually or tacitly after 24 hours), the buyer can request the return of their deposit at any time from their personal account:
My profile > Deposit management > Request refund
Refund requests are only possible if the buyer has no other transactions in progress.
Refunds are processed within two working days (in accordance with Article 10.3).
8.7.8. Complaints and disputes
In the event of a problem with the vehicle (non-compliance with the advertisement, hidden defect, etc.), the buyer may create a dispute before confirming delivery.
The dispute is created from the vehicle reservation page in the Cartobike personal space.
Once a dispute has been opened:
- CARTOBIKE creates a mediation file
- A mediator will attempt to find an amicable solution between the buyer and the seller
- The transaction is suspended for the duration of the mediation
Important: CARTOBIKE acts as a technical intermediary and does not take sides in the dispute. The buyer was invited to inspect the vehicle before payment (see Article 8.7.3). CARTOBIKE is not a party to the sales contract between the buyer and the seller.
8.7.9. Summary of statuses
Status: "Reserved"
Meaning: Offer accepted by seller, vehicle blocked for at least 5 days
Next action: Buyer: inspect the vehicle then pay
Status: "Delivery in progress"
Meaning: Payment received by seller, buyer's deposit released
Next action: Buyer: confirm delivery (within 24 hours)
Status: "Delivered"
Meaning: Transaction finalised (manual confirmation or tacit confirmation after 24 hours)
Next action: Buyer: retrieve deposit if no other transactions in progress
Article 9 - Purchase
9.1. Purchase commitment
By making a fixed-price offer or bidding, the User is legally bound to purchase the vehicle if their offer is accepted or if they win the auction.
9.2. Buyer's obligation
The buyer undertakes to:
- Read the vehicle description in full before purchasing
- Pay the agreed price within the specified time frame (see Marketplace Rules)
- Take delivery of the vehicle under the conditions agreed with the seller
9.3. Limitation on simultaneous bids (private individuals)
Article 9.3 - Limitation on simultaneous bids (private individuals)
9.3.1. General principle
Private buyers may bid on only one vehicle at a time.
9.3.2. Exception: Multiple bids
If a private user bids on several vehicles simultaneously (for example, by opening several windows or in the case of auctions ending at similar times), they are expressly informed of the following rules:
If you win several simultaneous auctions, you are obliged to pay for ALL the vehicles you have won. You cannot choose a single vehicle from among those you have won and abandon the others.
9.3.3.Consequences of abandoning a vehicle you have won
If you win several auctions and abandon one of the vehicles won (non-payment, non-finalisation), you will permanently lose the deposit paid for that vehicle, in accordance with Article 10.3.4. This loss of deposit applies to EACH vehicle abandoned.
9.3.4.Obligation to ensure your ability to pay
Before bidding, the User must ensure:
- That they have the necessary funds to pay for the vehicle(s) within the specified time frame
- That they have obtained a valid and definitive financing agreement (if financing), That they can honour their commitments within 5 working days of the close of the auction (or more in the event of a written agreement with the seller).
9.3.5. Refusal of financing
A refusal of financing after winning the auction cannot be accepted as a valid reason for cancellation.
The User must obtain financing approval BEFORE bidding. Subsequent refusal will result in the loss of the deposit.
9.3.6. Reminder of payment deadline
The User has a maximum of 5 working days to pay for the vehicle won, unless a written agreement has been made with the seller to extend this deadline.
After this period, the deposit is permanently forfeited and the vehicle may be put back up for sale.
Article 10 - Auction Deposit
10.1. Deposit requirement
In order to participate in auctions, each User must deposit a single deposit in advance to participate in all auctions, which is refundable in accordance with the terms set out in Article 10.3.
10.2. Variable amount
The amount of the deposit may change over time. CARTOBIKE will systematically communicate the amount applicable at the time of the auction on the dedicated page.
10.3. Refund
10.3.1. Terms and conditions for requesting a refund
Users may request a refund of their deposit at any time via their Cartobike personal account.
To request a refund, simply follow this path:
My profile > Deposit management > Request refund
10.3.2. Processing time
Refund requests are processed within a maximum of 2 working days
of receipt.
The refund is then made using the same payment method used
when the deposit was paid (credit card, bank transfer, etc.).
10.3.3. Cases where refunds are blocked
Refunds of the deposit are not possible in the following cases:
a. The User has the best bid on an ongoing auction
b. Their bid has been accepted by the seller but they have not finalised the purchase
in accordance with these terms and conditions (payment and collection of the vehicle
within 5 working days)
10.3.4. Loss of deposit
In the cases provided for in Article 10.3.3, the deposit may be retained in full as a penalty, without prejudice to the right of CARTOBIKE or the seller to claim specific performance or additional damages.
The deposit shall be forfeited automatically in the event of non-compliance with the
the commitments of the User who has won an auction.
10.4. Service fees
When the deposit is paid, a fixed service fee is charged to the User. This fee covers, in particular:
- Bank transaction fees (e.g. Stripe)
- Costs related to dispute management and any mediation
The deposit is fully refundable under the conditions set out above. However, service fees remain the property of CARTOBIKE and are non-refundable, regardless of the outcome of the auction.
Article 11 - Liability
11.1. Role as intermediary
CARTOBIKE is a technical intermediary. We are not a party to the sales contracts concluded between Users.
11.2. No warranty
CARTOBIKE does not guarantee:
- The accuracy, truthfulness or completeness of the advertisements published
- The quality, conformity, safety or legality of the vehicles sold
- The ability of sellers to sell or buyers to pay
- The conclusion or effective execution of transactions
11.3. Impossible verification
CARTOBIKE is unable to verify all of the information published on the Platform. The responsibility for the accuracy of advertisements lies solely with the sellers.
11.4. Limitation of liability
To the extent permitted by law, CARTOBIKE declines all liability for:
- Financial losses related to a transaction
- Disputes between Users
- Viruses, loss of data or damage to your computer equipment
- Temporary or permanent interruption of the Platform
- Errors, bugs or inaccuracies on the Platform
11.5. Limitation
In any event, CARTOBIKE's liability, regardless of the cause, shall not exceed €150 per User.
11.6. Exclusions
Nothing in these Terms of Use shall limit or exclude CARTOBIKE's liability in the event of:
- Death or personal injury resulting from our negligence
- Fraud or fraudulent misrepresentation
- Any liability that cannot be excluded or limited by law
Article 12 - Intellectual Property
12.1. CARTOBIKE content
All elements of the Platform (text, graphics, software, databases, trademarks, logos) are the exclusive property of CARTOBIKE or are subject to authorisation for use.
Any reproduction, representation, adaptation or exploitation, even partial, is prohibited without prior written authorisation.
12.2. User Content
By publishing content (advertisements, photos, comments), the User grants CARTOBIKE a worldwide, non-exclusive, free and transferable licence to:
- Display, reproduce and distribute this content on the Platform
- Share it on partner sites and social networks
- Use it for statistical evaluation and service improvement purposes
The User guarantees that they hold all necessary rights to the content they publish.
Article 13 - Personal Data
The processing of personal data is governed by our Privacy Policy, which can be accessed at: https://cartobike.com/fr/privacy-policy
Article 14 - Term and Termination
14.1. Term
The User account is active indefinitely until it is deleted by the User or by CARTOBIKE.
14.2. Termination by the User
The User may delete their account at any time in accordance with the terms of Article 4.
14.3. Termination by CARTOBIKE
CARTOBIKE may suspend or permanently delete a User's account in the event of:
- Violation of these Terms of Use
- Fraudulent, illegal or abusive behaviour
- Repeated non-payment or disputes
- Use of false identity documents
Suspension or deletion shall be notified by email. The User shall have 15 days to submit their comments, except in cases of obvious fraud justifying immediate suspension.
Article 15 - Modification of the Terms and Conditions
CARTOBIKE reserves the right to modify these Terms of Use at any time to adapt to legal, technical or commercial developments.
The amendments shall come into force as soon as they are posted online. Continued use of the Platform after the amendment shall constitute acceptance of the new terms and conditions.
Article 16 - Applicable law and jurisdiction
16.1. Applicable law
These Terms of Use are governed by Belgian law, in particular the Economic Law Code.
16.2. Mediation
Before taking any legal action, the consumer User may seek the assistance of a mediator free of charge (see contact details in the Legal Notice).
16.3. Competent jurisdiction
In the absence of an amicable solution, the Belgian courts shall have sole jurisdiction.
Article 17 - General Provisions
17.1. Partial invalidity
If any provision of these Terms of Use is declared void or unenforceable, the other provisions shall remain in full force and effect.
17.2. No waiver
The fact that CARTOBIKE does not invoke a clause of these Terms of Use does not constitute a waiver of its right to invoke it at a later date.

Preamble
These General Terms and Conditions of Use for Professionals (hereinafter "GTCU for Professionals") govern the use of the CARTOBIKE platform by professional sellers (hereinafter the "Professional" or "Professionals").
They supplement the General Terms and Conditions of Sale - Professionals, which govern the commercial aspects of the subscription.
Article 1 - Definitions
Professional: Any legal entity or natural person acting in the course of their commercial, industrial, craft or liberal activity.
Platform: The CARTOBIKE marketplace accessible via websites and mobile applications.
Advertisement: Descriptive sheet of a vehicle offered for sale by a Professional.
Buyer: Private or professional user who purchases or wishes to purchase a vehicle.
Article 2 - Acceptance of the Professional Terms and Conditions
2.1. Registration and use of the Platform as a Professional implies full and complete acceptance of these Professional Terms and Conditions of Use and the General Terms and Conditions of Sale - Professionals.
2.2. These terms and conditions prevail over any other document, in particular the Professional's general terms and conditions.
Article 3 - Professional Registration
3.1. Registration conditions
Professional registration is reserved for:
- Legally constituted legal entities
- Natural persons of legal age engaged in a declared professional activity
3.2. Required information
When registering, the Professional shall provide:
- Company name or trade name
- Legal form
- Company number / SIREN
- Intra-Community VAT number
- Address of registered office
- Contact details of legal representative (surname, first name, position)
- Business email
- Work telephone number
- Billing contact details (if different)
- Business address(es) of points of sale
3.3. Supporting documents
3.3.1. Purpose of verification
The optional verification procedure allows CARTOBIKE to:
• Maintain trust within the professional community
• Prevent fraud and commercial identity theft
• Offer increased visibility to verified Professionals via the "Verified Pro" badge
• Facilitate the resolution of any disputes
3.3.2. "Verified Pro" badge - Benefits
Professionals who have completed the verification process benefit from:
• A distinctive "Verified Pro" badge visible on their profile and listings
• Enhanced credibility with buyers (individuals and professionals)
• Priority access to certain advanced features (professional auctions, B2B Hot Deals)
• Better visibility in search results
3.3.3. Optional but recommended
IMPORTANT: The provision of verification documents remains OPTIONAL and is NOT a condition for access to a professional account.
However, CARTOBIKE reserves the right to request these documents:
• In the event of a dispute involving the Professional
• In case of serious doubt about the identity or declared activity
• To access certain features reserved for verified accounts
• If the Professional's volume of activity exceeds certain thresholds (e.g. > 20 vehicles/year)
3.3.4. No immediate penalty
Failure to submit documents within 30 days:
• Does NOT result in account suspension
• Does NOT prevent the use of basic features (advertisements, standard auctions)
• Only results in the loss of the "Verified Pro" badge and associated benefits
3.3.5. Confidentiality of documents
Documents submitted are processed in accordance with the GDPR and CARTOBIKE's Privacy Policy. They are:
• Stored securely and confidentially
• Used solely for identity verification purposes
• Kept for the duration of the account's activity + 5 years (Belgian legal accounting and tax obligations)
• Accessible only to authorised CARTOBIKE staff
3.4.1. Registration
Registration for a Professional account is free and immediate.
No documents are required during initial registration.
3.4.2. Request for verification documents (optional)
Within 30 days of registration, CARTOBIKE may request that the Professional send the following documents by email to
• Kbis extract or equivalent (less than 3 months old)
• Identity document of the legal representative
• Proof of professional liability insurance
These documents enable the "Verified Professional" badge to be obtained, which is visible on the profile and advertisements.
3.4.3. Submission deadline
The Professional has 30 days from the date of the request to submit the documents.
After this period, the account remains active but does not benefit from the "Verified Professional" badge.
3.4.4. Advantages of the "Verified Professional" badge
The "Verified Professional" badge (✓) offers:
- Increased visibility in search results
- Increased trust among buyers
- Priority access to premium features
3.4.5. Right of additional verification
CARTOBIKE reserves the right to request any additional documents in the event of:
- Serious doubt about the authenticity of the account
- Repeated reports from users
- Suspicion of fraud or identity theft
- Ongoing litigation
In the event of refusal to provide documentation or non-compliant documentation, CARTOBIKE may temporarily suspend the account until the situation is rectified or proceed to cancel it
3.4. Payment method
The Professional must have a valid payment method permanently registered on the Platform for the subscription and renewal of the subscription.
Article 4 - Subscription and Services
The terms and conditions for subscribing, pricing, renewing and cancelling the subscription are governed by the General Terms and Conditions of Sale - Professionals.
The services included in the subscription are detailed in the GTC for Professionals and on the subscription page.
Article 5 - Obligations of the Professional Seller
5.1. Legal compliance
The Professional undertakes to:
- Comply with all legislation applicable to its activity (Economic Law Code, Consumer Code, automotive regulations)
- Have all the necessary authorisations to carry out its activity
- Comply with European standards applicable to the vehicles sold
5.2. Accuracy of advertisements
The Professional guarantees:
- The accuracy and sincerity of all information published (condition, mileage, history, equipment)
- The authenticity of the photos (actual photos of the vehicle, no generic photos unless explicitly stated)
- The actual availability of the advertised vehicles
- The accuracy of the price displayed (including all taxes)
CARTOBIKE may automatically generate certain technical information. The Professional must check and validate this information before publication. By publishing the advertisement, they expressly acknowledge the accuracy of all the data displayed.
5.3. Stock and availability
The Professional undertakes to:
- Keep the availability of their vehicles up to date
- Remove or mark as "Sold" any vehicle that is unavailable within a maximum of 24 hours
- Honouring accepted offers as long as the advertisement is active
5.4. Photos and intellectual property
The Professional guarantees that they hold all rights to the photos published. The use of licensed images without authorisation exposes the Professional to penalties and the removal of the photos concerned by CARTOBIKE.
5.5. Status of advertisements
After accepting an offer, the Professional must change the status of the advertisement:
- "Reserved": vehicle currently being sold
- "Sold": transaction finalised
Article 6 - Publication Rules
6.1. Prohibitions
It is prohibited to publish:
- Multiple advertisements for the same vehicle
- Vehicles that are unavailable or on order (unless delivery times are explicitly stated)
- Advertisements in the form of purchase requests
- Vehicles that do not comply with European standards
- Fictitious or misleading prices
- Premium rate numbers (0900, etc.) as contact details
6.2. Moderation
CARTOBIKE reserves the right to:
- Delete, modify or hide any non-compliant advertisement
- Request additional supporting documents (certificate of compliance, invoices, etc.)
- Suspend or terminate the account in the event of repeated violations
6.3. Publication time
Advertisements are generally displayed within 24 hours. CARTOBIKE cannot guarantee an exact time for posting or a specific ranking in search results.
Article 7 - Relationship with Buyers
7.1. Transmission of contact details
When an individual interacts with a professional advertisement (request for information, offer), CARTOBIKE may transmit the following contact details to the Professional:
- Surname, first name
- Telephone number
- Postcode
7.2. Use of contact details
The Professional undertakes to:
- Use this contact information solely for the purposes of the transaction in progress
- Comply with the GDPR and data protection legislation
- Not reselling, transferring or using this data for other purposes without the buyer's explicit consent
- Respond to requests within a reasonable time frame
7.3. B2C rules (sales to consumers)
In the context of B2C sales, the Professional must:
- Respect the 14-day right of withdrawal (except in cases where there are legal exceptions)
- Provide all mandatory pre-contractual information
- Honour legal guarantees (conformity, hidden defects)
- Comply with the obligations of the Consumer Code or equivalent
Article 8 - Obligations towards CARTOBIKE
8.1. Payment of the subscription
The Professional undertakes to pay their subscription in accordance with the terms and conditions of the Professional T&Cs.
8.2. Notification of disputes
The Professional must inform CARTOBIKE of any serious dispute with a buyer that could impact the reputation of the Platform.
8.3. Respect for competition
The Professional shall refrain from:
- Denigrating other professional sellers on the Platform
- Manipulating reviews or ratings
- Using unfair commercial practices
Article 9 - Ratings and Reviews
9.1. Rating system
Buyers may rate the Professional and leave reviews after a transaction.
9.2. Responding to reviews
The Professional may respond publicly to reviews received within 30 days.
9.3. Removal of Reviews
CARTOBIKE may delete a review that is clearly defamatory, abusive or false upon reasoned request from the Professional, after verification.
Article 10 - Showcase Page
10.1. Content of the showcase page
The Professional has a showcase page presenting:
- Their professional identity
- Their active advertisements
- Their ratings
- Their contact details
10.2. Customisation
The Professional may customise their showcase page (logo, banner, description) within the limits defined by CARTOBIKE and subject to compliance with the publication rules.
Article 11 - Multi-shops
Professionals with multiple points of sale may manage multiple shops from a single account, in accordance with the terms and conditions of the subscription.
Article 12 - Professional's responsibility
12.1. The Professional is solely responsible for:
- The accuracy of the information published
- The compliance and legality of the vehicles sold
- Compliance with their contractual obligations towards buyers
- Disputes with buyers
12.2. Indemnification
The Professional undertakes to compensate CARTOBIKE for any claim, legal action or conviction resulting from:
- Inaccurate or misleading information in its advertisements
- The non-compliance of its vehicles
- Violation of intellectual property rights
- Breaches of its legal or contractual obligations
Article 13 - CARTOBIKE's liability
13.1. CARTOBIKE acts as a technical intermediary and is not a party to the sales contracts concluded between Professionals and buyers.
13.2. CARTOBIKE does not guarantee:
- The number of visitors or contacts generated
- The effective conclusion of sales
- The quality or creditworthiness of buyers
13.3. To the extent permitted by law, CARTOBIKE's liability shall not exceed the amount of the Professional's annual subscription.
Article 14 - Personal Data
The processing of personal data is governed by our Privacy Policy.
The Professional acts as an independent data controller for the buyer data it collects and undertakes to comply with the GDPR.
Article 15 - Term and Termination
15.1. The duration of the professional account is linked to the duration of the subscription (see Professional Terms and Conditions).
15.2. Termination by CARTOBIKE
CARTOBIKE may suspend or terminate the professional account in the event of:
- Non-payment of the subscription
- Violation of these Terms and Conditions
- Fraudulent behaviour or unfair commercial practices
- Multiple disputes with buyers
- Damage to CARTOBIKE's image
Termination shall be notified by email with a 15-day period for comments, except in cases of serious misconduct justifying immediate termination.
15.3. Consequences of termination
In the event of termination:
- Active listings are deactivated
- Unused credits and services are permanently lost (see Professional Terms and Conditions)
- No refund is due
Article 16 - Modification of the Terms of Use
16.1. Right to modify
CARTOBIKE reserves the right to modify these Terms of Use at any time,
in particular to:
- Adapt to legal and regulatory changes
- Improve the services offered
- Enhance the security of the Platform
- Clarify certain provisions
16.2. Notification of changes
Any changes to the Terms of Use will be notified by email
informing the User that a new version is available online.
The notification email shall contain:
- A summary of the main changes
- The date on which the new Terms of Use come into effect
- A direct link to the new full version of the Terms of Use on the website
The new Terms of Use are available at any time at the following address:

16.3. Effective date
The amendments shall take effect 30 days after the notification email is sent

- Changes required by law (immediate entry into force)
- Changes favourable to the User (immediate entry into force)
- Compelling security reasons (effective within 7 days)
16.4. Acceptance of the new terms and conditions
Continued use of the Platform after the amendments come into effect constitutes acceptance of the new terms and conditions.
16.5. Refusal of amendments
If the Professional refuses the amendments to the General Terms and Conditions of Use, they may terminate their account in accordance with the terms set out in Article 4 - Account termination (Document 3 - Professional Terms and Conditions of Use).
Termination must take place before the date on which the new Terms and Conditions come into force in order to avoid tacit acceptance.
Termination procedure in the event of refusal of the amendments:
- Opposition period: The Professional has a period of 30 calendar days from receipt of the notification email to express their refusal and terminate their account.
- Termination procedure: Termination can only be carried out via the professional area: My account > Settings > Terminate my account
- Tacit acceptance: If the Professional continues to use the Platform after the effective date of the new Terms and Conditions without terminating their account, they are deemed to have tacitly accepted the changes.
- Consequences of termination:
- Immediate access: The professional account is deactivated immediately after the cancellation request.
- Online advertisements: All active advertisements are automatically deleted.
- Personal data: Account data is retained in accordance with the Privacy Policy (legal retention period: 5 years for Belgian accounting and tax obligations).
- Current subscription (if applicable): If the Professional has a paid subscription (Professional Terms and Conditions - Document 4), it is terminated in accordance with the terms set out in Article 6 - Termination and deactivation of renewal (Document 4 - Professional Terms and Conditions).
- No pro rata refunds: Amounts already paid will not be refunded (unless otherwise provided by law).
- Exception for technical difficulties: In the event of proven technical impossibility to access the termination interface, the Professional may send a request by email to customer@cartobike.com, attaching:
- A screenshot or video of the technical problem encountered
- Their professional account number
- The explicit statement: "I refuse the changes to the Terms and Conditions of Use of [DATE] and wish to terminate my account in accordance with Article 16.5"
- Confirmation of cancellation: CARTOBIKE will send a cancellation confirmation email within 48 working hours specifying:
- The effective date of account closure
- The consequences (deletion of listings, data retention, end of subscription)
- Customer service contact details for any questions: customer@cartobike.com
16.6. Retention of previous versions
CARTOBIKE keeps a history of previous versions of the Terms and Conditions, which can be accessed on request atcustomer@cartobike.com
Article 17 - Applicable law and jurisdiction
17.1. These Terms of Use are governed by Belgian law.
17.2. In the event of a dispute, the parties undertake to seek an amicable solution before taking any legal action.
17.3. In the absence of agreement, the commercial courts of Brussels shall have sole jurisdiction.
