1. Acceptance of Terms

By accessing or using 1Platform ("the Service"), operated by 1Platform Labs ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms apply to all users of the Service, including API consumers, dashboard users, and any other visitors or integrators. We reserve the right to update these Terms at any time, and continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Description of Service

1Platform is a unified platform that integrates multiple business solutions, including but not limited to:

  • AI-powered content generation
  • Keyword research and analysis
  • Image sourcing and generation
  • Comment automation
  • Profile management
  • Legal page generation
  • CMS publishing
  • Google indexing
  • Link building
  • Payment processing
  • Electronic invoicing
  • NFC solutions

All services are accessible through our unified REST API and/or the 1Platform dashboard.

3. Account Registration

To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for:

  • Maintaining the confidentiality of your API tokens and credentials
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorized use of your account

You must be at least 18 years of age to create an account. Accounts are non-transferable without our prior written consent.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe upon the intellectual property rights of others
  • Generate, distribute, or publish spam, malware, or harmful content
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with the proper functioning of the Service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to create competing products
  • Resell or redistribute the Service without authorization
  • Generate content that is illegal, defamatory, or violates the rights of others

5. API Usage

The 1Platform API is subject to the following terms:

  • Authentication: All API requests must include valid authentication tokens. The Service uses a two-token system: an application token (Authorization: Bearer) and a user token (x-user-token header).
  • Rate Limits: API usage is subject to rate limits based on your subscription plan. Exceeding rate limits may result in temporary throttling or suspension.
  • Usage Quotas: Each subscription plan includes specific usage quotas. Exceeding quotas may result in additional charges or service restrictions.
  • API Versioning: We may update or deprecate API versions. We will provide reasonable notice before removing support for any API version.

6. AI-Generated Content Disclaimer

Content generated through our AI services is produced algorithmically and may require human review before publication. You acknowledge that:

  • AI-generated content may contain inaccuracies or errors
  • You are solely responsible for reviewing, editing, and approving all generated content before use
  • We make no guarantees about the accuracy, quality, or suitability of AI-generated content
  • AI-generated content should not be used as a substitute for professional advice (legal, medical, financial, etc.)
  • You retain responsibility for ensuring generated content complies with all applicable laws and regulations

7. Intellectual Property

The Service, including its source code, design, documentation, and branding, is owned by 1Platform Labs and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written consent.

Content you create or generate through the Service remains your property. By using the Service, you grant us a limited license to process, store, and transmit your content solely for the purpose of providing the Service.

8. Payment and Billing

Certain features of the Service require a paid subscription. By subscribing to a paid plan, you agree to:

  • Pay all fees associated with your chosen plan
  • Provide accurate and complete billing information
  • Authorize recurring charges as specified by your subscription plan

Prices are subject to change with 30 days' prior notice. All fees are non-refundable unless otherwise stated in our refund policy or required by applicable law.

9. Payment Security

1Platform never stores your credit card data on our servers. All payment transactions are processed through PCI DSS-certified payment processors. We use industry-standard encryption and security measures to protect your financial information during transmission.

10. Third-Party Services

The Service integrates with third-party providers to deliver certain capabilities, including AI processing, search data, image sourcing, payment processing, and invoicing. By using the Service, you acknowledge that:

  • Certain data may be shared with third-party providers as necessary to deliver the Service
  • Third-party services are subject to their own terms and conditions
  • We are not responsible for the actions, content, or policies of third-party providers

11. Data Retention

We retain your data for as long as your account is active or as needed to provide the Service. Upon account deletion:

  • Personal data is deleted within 30 days
  • Generated content and API logs are retained for up to 90 days
  • Billing records are retained as required by applicable law
  • Anonymized, aggregated data may be retained indefinitely for analytics purposes

12. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We reserve the right to:

  • Perform scheduled maintenance with reasonable prior notice
  • Take the Service offline for emergency maintenance
  • Modify, suspend, or discontinue any part of the Service

We are not liable for any downtime, data loss, or service interruptions, whether planned or unplanned.

13. Limitation of Liability

To the maximum extent permitted by law, 1Platform Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, revenue, or data
  • Business interruption
  • Cost of substitute services
  • Damages resulting from AI-generated content

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

14. Termination

Either party may terminate the agreement at any time. We reserve the right to suspend or terminate your account immediately if you violate these Terms, without prior notice or liability.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and dispute resolution) shall survive.

15. Modifications to Terms

We may revise these Terms at any time by posting the updated version on our website. Material changes will be communicated via email or through the Service dashboard. Your continued use of the Service after the effective date of any changes constitutes acceptance of the revised Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Guatemala. Any disputes arising from these Terms or the Service shall be resolved through the courts of Guatemala City, Guatemala.
